Who has parental rights under this new Act?
A parent has the same meaning as Section 135(1) of the Education (Scotland) Act 1980 and includes guardian and any person who is liable to maintain or has parental responsibilities in relation to, or has care of, a child or young person.
What rights does a parent have under the new Act?
The Act introduces 12 new rights for parents (and young people, aged 16-18 on their own behalf)

How will a parent or young person be made aware of their new rights?
The authority has a duty to publish, review and update information about the Additional Support for Learning Act policies and guidelines. This will include information for parents.
To whom will a parent complain if their child does not get a Coordinated support plan?
The Additional Support Needs Tribunal will hear references from parents and young people on matters relating specifically to Coordinated support plans.

What if a school wishes to prepare a Coordinated support plan for a child or young person but the parent or young person is against this?
The authority is able to draw up a Coordinated support plan even where the parents disagree or refuse to cooperate. In such circumstances the parent can refer the authority’s decision to the tribunal. The parent or young person must be given a copy of the CSP once it has been prepared.
